Our best laws punish wicked people for their bad acts. But antitrust laws punish our best companies for their virtues -- for their exceptionally successful pursuit of profits through voluntary, win-win transactions. Our best laws are clearly worded, so that people can understand in advance of acting whether they are violating the law. But antitrust laws are notoriously (and uncontroversially) vague and rubbery, so that businessmen can't tell when they are breaking the law. When does that high-tech start up become a monopolizer? Nobody knows until the FTC or DOJ investigates. What's going on here?
